The 60 year old teen idol was weaving on and off the road a number of times the Florida Turnpike around 8:00 p.m. ET has finally been caught.
According to police, David Cassidy told the soldier he had drunk a glass of wine at dinner and popped a painkiller hydrocodone a few hours before the arrest.
The police ordered the father of the Gossip Girl star Katie David Cassidy (who was herself a DUI bust in 2007) out of the car and said he was "swaying while standing."
David Cassidy took a breath and blew a .139 and .141 - way over the legal limit of 0.08. A half-empty bottle of Bourbon was later found in his Mercedes.
David Cassidy was taken to a prison nearby and booked for driving while impaired.
The actor is adamant he was not hammered on alcohol when he took the wheel last night and said he plans to fight DUI charges against tooth and nail.
He admits he did take a pill for his back pain earlier in the day and perhaps tired from a funeral morning he would attend, but he was not drunk.
David Cassidy is also contesting the results of two breath tests he took at the time of arrest, stressing his true BAC could not have been properly measured.
David Cassidy rep says the actor is already looking for a lawyer and plans to fight against the charges added: "He would never compromise anyone on the road."
"It would not have been driving if he had not had to go to a funeral ... he was never arrested before in his life for nothing."
